Terms and Conditions of Service BAL Consultants Trading as bal-it.com (“BAL”, “we”, “us”, “our”) These Terms and Conditions govern all IT support services provided by BAL Consultants to individuals and small organisations (“you”, “the client”). By booking, requesting, or allowing us to carry out services, you agree to be bound by these Terms.
- Services Provided BAL provides general IT support services including, but not limited to: • Computer and laptop support • Mobile phone and tablet support • Software installation and troubleshooting • Hardware diagnostics and basic repairs • Network and internet setup • Data transfer and basic recovery attempts • General advice and maintenance Services may be provided on-site, remotely, or at a BAL-approved location.
- No Guarantee of Outcome While BAL will take reasonable care and skill in providing services, we do not guarantee that: • A fault can be repaired • Data can be recovered • Equipment will function as expected after service • Issues will not recur All services are provided on a best effort basis.
- Data, Backup, and Data Loss • You are solely responsible for ensuring that all important data is fully backed up before any work begins. • BAL is not responsible for any loss, corruption, or breach of data, whether existing or occurring during or after service. • Where data backup or transfer services are requested, these are still subject to technical limitations and no guarantee is given.
- Damage to Equipment • Some repairs or diagnostics may involve inherent risks, especially where equipment is already faulty, damaged, or modified. • BAL will not be liable for: o Pre existing faults or damage o Manufacturer defects o Damage resulting from hardware failure during service o Cosmetic damage where unavoidable (e.g. opening sealed devices) • Any replacement parts may not be manufacturer original unless explicitly stated.
- Accidental Damage to Other Property BAL will take reasonable care while working on your premises. However, BAL shall not be liable for: • Accidental damage to surrounding property unless caused by proven negligence • Indirect or consequential losses Our total liability, where applicable, is limited to the cost of the service provided.
- Limitation of Liability To the maximum extent permitted by law: • BAL shall not be liable for loss of profits, business, data, or goodwill • BAL’s total liability shall not exceed the total fees paid for the relevant service • Nothing in these Terms limits liability for death or personal injury caused by negligence, or for fraud
- Right to Refuse or Terminate Service BAL reserves the right to refuse or discontinue service at any time, including (but not limited to): • Unsafe working conditions • Abusive, threatening, or inappropriate behaviour • Suspected illegal activity • Non payment or previous non payment • Requests outside our expertise Payment will still be due for work already carried out.
- Payment Terms • Standard hourly rates are: o £45 per hour for home (residential) users o £75 per hour for business users • For specific jobs, projects, or support contracts, pricing will be agreed directly with the client in advance and confirmed in writing where possible. • For on-site visits more than 20 minutes’ drive from BAL’s base in Llantwit Major, a minimum fee of £15 (equivalent to 20 minutes of work) will be charged to cover travel costs. • Fees will be agreed in advance where possible, but estimates are not guarantees. • Payment is due immediately upon completion of the service unless otherwise agreed in writing. • BAL reserves the right to retain possession of client equipment until full payment has been received. • BAL also reserves the right to suspend services or withhold return of equipment in the event of non-payment. • Late payments may incur additional charges.
- Cancellations and Missed Appointments • Cancellations must be made with reasonable notice. • BAL reserves the right to charge for missed appointments or late cancellations.
- Client Responsibilities You agree to: • Provide accurate information about the issue and equipment • Ensure legal ownership of devices and software • Remove or disclose passwords, encryption, or restrictions where required • Ensure a safe and suitable working environment
- Software, Licensing, and Third Party Services • BAL is not responsible for licensing compliance unless explicitly agreed. • Any third party software or services are subject to their own terms. • BAL is not responsible for failures or changes made by third party providers.
- Confidentiality BAL will treat client information as confidential and will not knowingly disclose it to third parties, except where required by law or necessary to provide the service.
- Force Majeure BAL shall not be liable for delays or failures caused by events beyond reasonable control, including power outages, internet failures, natural disasters, or supplier issues.
- Governing Law These Terms and Conditions are governed by the laws of England and Wales, and any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
- Acceptance of Terms By requesting or allowing BAL Consultants to provide services, you confirm that you have read, understood, and agreed to these Terms and Conditions.
